Karary University Act 2008   (18/2/2008)

 The Academy law was modified to be the University of Karary to accommodate the rest Military Colleges in a Military University. after the adjustment of the programs, to match the requirements of the Ministry of Higher Education like any other universities locally or Internationally. Due to the evolution of science and technology, the war modern machines shifted accordingly, thus the military institutions of training must facilitate and qualify the individual qualifications to suits the modern levels of an advanced armies as well.
The national assembly in its (27th) session dated 16 Feb, 2008, had passed a provision of signing the law and regulation, attested by the President, and the higher Military Command the sponsored of the University of Karary in 18TH Feb. 2008.

 

 Preamble rules  Act name
1-This act is named " Karary University Act 2008"
Cancellation and exemption
2- Karary Academy of technology Act   of 1996 will be cancelled where the regulations rules and systems issued according it will be valid till their cancellation or reformation according to this act.
Interpretation
3- In this act , unless the context affords another meaning :
"The university" is meant here is Karary University constituted according to article 4,
"Secretary of academic affairs" is meant here the person responsible about university academic affairs who is assigned to article 18 (1),
"Secretary of libraries affairs" is meant here the person the person responsible about university libraries affairs who is assigned to article 19 (1),
"Graduate" is meant here anyone awarded an academic degree by Professors assembly,
"Sponsor" is meant here University sponsor mentioned in article7 (1),
"Head of the senate" is meant here the person who is assigned according to article 12 (1),
"Head of department or unit" is meant here the person who is assigned according to article 21 (1),
"Student" is meant anyone who is registered in the university to get an academic degree,
"Labors" are meant here teaching staff members, their assistants, technicians, administrative persons, employees and workers,
"Dean of students' affairs" is meant here the person who is responsible about students' affairs and who is assigned according to rules of article 23(1),
"Dean of college or school" is meant the person, who is assigned according to rules of article 20(1),
"Unit or department" is meant an unit of teaching or research or raining following to a college appointed by the council with a recommendation from professors assembly according to basic systems as an entity on its own,
" college or school" is meant any academic unit constituted by the council according to rules of this act , it includes a number of departments or centers relevant to the university due to what the council designate on a recommendation of professors assembly,
"Committee" is meant the committee of administrative and financial affairs constituted according o rules of article 13,
" regulations" are meant the regulations issued by the council and professors assembly and councils of colleges , schools, institutes, centers and units according to the rules of this act ,
"Senate" is meant the university senate constituted according to rules of article 8(1),
"Professors assembly" is meant the assembly constituted according to rules of article 24,
"National council" is meant national council of high education and scientific research,
"Chancellor" is meant the chancellor of the university, who is assigned according to rules of article 15,
"Head of the institute or the center" is meant the person who is assigned according to rules of article 20 (1),
"Teaching assistants" are meant assistants of teaching staff,
"The institute or the center" is meant any scientific unit independent or following to a college constituted by the senate for teaching or research or training according to the rules of this act,
"Vice chancellor" is meant vice chancellor, who is assigned according to rules of article 17,
"Basic systems" is meant the basic systems issued by the senate according to rules of this act,
"Teaching staff" is meant those who are teachers, associate professors, assistant professors and lecturers,
"Minister" is meant the minster that is in charge of national defense,
"Specialized minister" is meant minister of high education and scientific research,
"Principal" is meant the person who is responsible about financial and administration affairs who is assigned according to the rules of article 22(1)

 

University
University constitution, premises and supervision

4 - (1) The University is established as an academic corporation of a military normality named “Karary University” of a considerable character and a general seal. It has the right of prosecution in its name. It has an independent budget, (1)      
(2) Headquarters of the university will be in Khartoum, and it has the right to establish branches anywhere in Sudan or out Sudan,
(3) The university is under the minister supervision in administration and finance, and the specialized minister supervision in academic and scientific affairs.
University emblem:-
5- The university has an emblem appointed by the senate.
University purposes:-
6- University is a corporation of scientific research, teaching, and training in all fields of sciences of military, professional, humanitarian, technological and relevant sciences, gives care to collect theses sciences, teaching and curricula development, according to the state general goals, the university works through colleges, institutes, centers and specialized units to train and quality specialized frames to serve various domains of sciences of military, professional, humanitarian and technological as it works to develop human resources and sponsor them in science and continuous training to serve and protect home scientifically, intellectually, culturally and socially without prejudice to what above mentioned . The university works to achieve the following goals:
(a) Confirmation and authentication of nation nationality in all of its programs and curricula.
(b) Preparation of student and rewarding them academic degrees in various sciences of military, professional, humanitarian, and technological.
(c) Applied and scientific researches in relevant science as an improvement of strategic capacities and development of national resources scientifically, intellectually, culturally and socially,
(d) Upgrading of technological frames and others scientifically, professionally and vocationally in various sectors of armed forces and community service.
7- (1) President of the republic will be a sponsor of the university.
(2) The sponsor of the university has the right to issue directions of general or specific normality related to university work, and the senate or the chancellor must work according to that directions.
(3) The sponsor or who is mandated by the sponsor will head graduation carnivals.

University bodies
Constitution of the senate

8- (1) the senate is constituted and named “the university council” accordingly:
(a) Head of the university council assigned by the sponsor Chairman.
(b) Members according to their positions, they are:
(Firstly) Chief of joint staff of armed forces – deputy chairman
(Secondly) The chancellor.
(Thirdly) vice chancellor.
(Fourthly) undersecretary – reporter.
(Fifthly) academic affairs secretariat.
(Sixthly) dean of student’s affairs.
(Seventhly) general secretariat of ministry of high education and scientific research.
(Eighthly) general secretariat of ministry of sciences and technology.
(Ninthly) general secretariat of ministry of defense.
(c) Members selected from the university:
(Firstly) Three members represent deans of colleges and institutes
(Secondly) Two members of staff teaching selected by the professor’s assembly.
(d) Three representative from armed forces among specialized.
(e) Seven members out of university among specialized, qualifications and concerns of high education, national issues, strategic and scientific issues assigned by the sponsor of the university according to the recommendations of specialized minister.
(2) Duration of the council is 4 years since its date of constitution.
(3) The regulations designate cases of member’s seat vacation and how to fill it.
Authorities and concession of the council:-
9- The council works to achieve university purposes mentioned in this act and high education and scientific research act 1990. The council has on behalf of the university and in its name to do all needed works to achieve university purposes in the framework of national policy of high education and scientific research and military strategic.
Without prejudice to what is mentioned above, the senate has the right of following authorities and concessions:
(a) Planning plans that lead to develop the university and improve university performance and methods of update its work.
(b) Approval of university administration and employment bodies.
(c) Establishing of colleges, schools, institutes, centers, departments, units or any other relevant establishment and their cancellation, designation of then places anywhere the council considers it suitable and authorize the members of these establishment the concessions of the university, all of this is according to a recommendation from professors assembly.
(d) Discussion and approval of the annual report represented by the chancellor about university scientific, financial and administrative performance.
(e) Possession in the name of the university to any movable assets or estates and their maintenance and right of running it in any legal method.
(F) Discussion of annual budget proposals after it preparation by the committee and following its approval through specialized bodies,
(g) Approval of agreement, suitable contracts to achieve university purposes,
(h) Rewarding non-scientific prizes for persons who deserve it according to regulations,
(i) Issue of basic systems and regulations according to rules of this act,
(j) Designation of number of accept students and their specializations with availability of need facilities in the framework of policies decided by the minister in consultation with specialized minister,
(k) Setting of study fees policies, registration fees and scholarships.
(l) Creation of the employment where labors are assigned or cancellation of that employments and suggestion of new conditions of recruitment and upgrading due to national council policies.
(m) Development of university assets and investment of these assets by contribution in companies or projects to benefit from revenues
(n) Organizing of the university accounts and to confirm that books are correct contain all money delivered to the university among revenues, expenditure and assets.
(o) Acceptance of donations, and designation of its ways use without contradiction of the university purposes
(p) Appointing of permanent or temporary committees to assist in achieving its duties whatever is necessary.
10- The senate has the right to mandate its authorities except construction, cancellation and issue of basic systems and regulation to its head or the cancellation and issue of basic systems and regulation to its head or the chancellor or professor’s assembly or any committee or any member among its members.
11- The senate will be responsible before the sponsor about its performance
12- Head of the senate concessions
        (a) To chair the senate,
        (b) To take initiatives Guarantee University purposes achievement.
        (c) To assist in all issues consolidate relation between the senate and other organizations to achieve university purposes.
        (d) To chair all sub-committees constituted by the senate unless it assign a chairman for these committees,                                 
2- In case of the senate head absence in any meeting, his vice will chair it.
Constitution of committee
13- Financial and administrative affairs committee
(a) Head at the senate - chairman
(b) The chancellor - deputy chairman
(c) Vice chancellor - member
(d) The undersecretary - reporter or member
(e) Financial auditor – member
(f) Two members selected by the council from the university – members
(g) Three members selected by the senate from its members out of the university
Committee concessions and authorities
14- Beside the authorities guaranteed by the basic systems, the committee has the following concessions and authorities:
(a) Preparation of university budget suggestions and passing of it to the senate, these budget must include estimations of revenues of the university coming year, expenditure and account of the university previous year and preparation of any extra estimations
(b) Invitation of any person to attend its meeting without having the right of vote.
The chancellor
15- The university has a chancellor of high scientific qualification to be assigned by the sponsor according to a recommendation from the minister after agreement with the basic systems and he might be assigned again.
The chancellor concessions and authorities:
16- The chancellor is the first scientific and executive official about university performance and its purposes achievement according to the sponsor directions and The senate policy and valid regulations, the chancellor is responsible before the sponsor through The senate head, without prejudice to what above mentioned, the
chancellor has the following concessions and authorities :
(a) Work to rationalize financial, administrative, military, educational and scientific performance and creation the methods help to exploit the best use of the university potentials according to The senate policy.
(b)To maintain the university system.
(c) To chair the professors assembly and eliminated committees and committees of teaching staff, their assistants, their upgrading and any other committees according to basic systems.
(d) To represent and speak on behalf university before other corporation.
(e) To introduce an annual comprehensive report about university scientific, administrative and financial performance
(f) To apply to the senate to issue basic systems and regulations.
(g) Any other task charged to him due to directions issued by the sponsor, national council or the senate.
Vice chancellor
17- (1) The vice chancellor of high scientific qualification assigned by the sponsor according to a recommendation from the minister in agreement with the specialized minister for four years renewable for one period due to service condition designated by basic systems.
(2) The vice chancellor assist the chancellor in his duties achievement, the vice chancellor has the concessions designated by basic systems.
(3) In case of the chancellor absences, incapability or vacation of his post, the vice chancellor assumes his charges according to the rules of regulations.
Academic affairs secretary
18- (1) according to a recommendation from the chancellor, the senate head assign one of teaching staff members of high qualification and experience as an academic affairs secretary.
(2) Basic systems and regulation designate the concession and duties of academic secretary.
(3) Academic secretary occupies his post for four years renewable for one period.
Libraries affairs secretary
19- (1) According to a recommendation from the chancellor, the senate head assign a high qualified secretary for libraries affairs.
(2) Libraries affairs secretariat occupies his position for four years renewable for one period.
(3) The basic systems and regulations designate the concessions, duties and service conditions of libraries affairs secretary.
(4) The libraries affairs secretary will be responsible before the chancellor about achieving his concessions and duties.
Deans of colleges and schools & head of institutes and centers
20- (1) Each college or school has a dean and each institute or center has a head to be assigned by the senate head according to the recommendation of the chancellor after consultation with council of college, school, institute or center with consideration of scientific rank.
(2)The dean of the college or school and the head of the institute or the Centre occupies his post for four years.
(3) The dean of the college or school and the head of the institute or the Centre will be responsible before the chancellor about the duties charged to him due to the rules of basic systems.
(4) The chancellor can assign a deputy for the dean of the college whenever needed after consultation with the specialized dean.
Head of departments and units
21- (1) each department or units has a head assigned by the chancellor according to the college dean recommendation.
(2) The head of the department or unit occupies his post for three years and renewable for one period.
(3) The head of department or unit will be responsible before the chancellor via the dean of the meant college in what is charged for him according to rules of basic systems and regulations.
Principal
22- (1) According to the chancellor recommendation, the head of the senate assign one of teaching staff members or senior administrative as an principal according to rules of basic systems and regulations.
(2) The principal occupies his post for four years renewable for one period.
(3) The principal will be responsible about university administrative and financial performance according to basic systems and regulations.
(4) The principal keeps university general seal and special record for all possessions of the university.

Student’s affairs dean
23- (1) According to the chancellor recommendation, the head of senate assign on of teaching staff members as student’s affairs dean,
(2) Student’s affairs dean occupies his post for four years renewable for one period.
(3) Basic systems designate the concessions of student’s affairs dean.

(4) Student’s affairs dean will be responsible before the chancellor of what is charged for him from the senate or professors’ assembly or other to help students make the maximum use scientifically, culturally and socially from loyalty to the university and keeping strictly to correct behavior in or out university according to systems and regulations.

Constitution of professors’ assembly
24- An assembly is constituted and named as “professors’ assembly” with a decision from the senate head as below:
(a) The chancellor – chairman
(b) Vice chancellor – member
(c) Principal – member
(d) Academic affairs secretariat – member and reporter
(e) Students’ affairs dean – member
(f) Libraries affairs dean – member
(g) Deans of college and schools – member
(h) Head of institutes and centers – member
(i) Head of departments and units – member
(j) All of teaching staff members in professorship rank – member
(k) Three of specialized in armed forced designated by the minister – member
(l) Five member out of the University of Scientific Experience designated by the minister after consultation with the specialized minister.
 

Professors’ assembly concessions and authorities
25 – (1) In addition to any concessions or authorities mentioned in this act.
Professors’ assembly enjoys the following concessions and authorities:
(a) Introducing suggestions to the senate around conditions and systems acceptance to study at the university.
(b) Setting acceptance condition in what agree with regulations and systems of acceptance according to national council
(c) General arrangement of study programs and examination which are concluded according to rules of basic systems.
(d) Preparations of plans to arrange college, schools, institutes, departments and units, and reconsideration of these institutions, in addition to appointing of curricula it teaches.
(e) Report to the senate of necessity to establish any college, school, institute, center or unit, to divide or merge.
(f) Reward academic degree for those who completed study successfully which appointed in regulations.
(g) Reward of honorary degree or scientific prizes for persons who deserve according to rules of regulations.
(h) Report to the senate about any issue the senate passes to the assembly.
(i) Encouraging of scientific researches, authorship and publishing and promotion of each.
(j) To approve programs of additional studies.
(k) Constitution of any suitable scientific councils and special committees mandated to each and authorizes to practice except rewarding scientific degrees.
(l) Recommendations consist of teaching staff members and their assistants’ assignment and upgrading.
(m) Procedures of audit according to its committees recommendations against whom are convicted in issues dishonest the scientific work among teaching staff, their assistants or students at the university or those whom it rewarded academic or honorary degrees.
(n) To forbid any person was convicted in moral crime, or according to the assembly opinion this person behaved a shameful behavior or dishonest in case this person was rewarded an academic degree by the assembly as the assembly has the right to forbid the person to enjoy the concession of this degree.
(2) The professors’ assembly issues the needed regulations of its meetings and their agenda, executes its concessions and practices its authorities according to the rules of this act and put on these regulations when its head sign it unless mentioning another date.

Councils of colleges, schools, institutes and centers and their concessions.
26- (1) each college, school, institute or center constitutes a council and arrange its agenda according to basic systems and regulations.
(2) Beside concessions mentioned in basic systems and regulations, councils of colleges, schools, institutes or centers enjoys the following issues:
(a) Preparation of plans and study curricula, examinations and coordination between different departments, and pass the recommendations to the professors’ assembly.
(b) Introducing of recommendations to professors’ assembly about regulations related to study curricula to receive scientific degrees and other issues related to scientific activity.
(c) Introducing of recommendations to professors’ assembly to reward scientific degrees “not honorary” and so prizes rewarded.
(d) Nomination persons to professors’ assembly as examiners.
(e) Encouraging and promotion of scientific research.
(f) Consideration of any issue related to scientific tasks according to way the professors’ assembly passes to, and to deliver a report about that issue.
(g) To pass all scientific issues related to post graduate studies to professors’ assembly.
(3) Councils of colleges, schools, institutes and centers have the right to issue disciplinary rules to care discipline among students in place of study.

Councils of departments & units:
27- (1) each department or unit constitutes a council under chairmanship of department or unit head with membership of all teaching staff members of the unit or department.
(2) The task of the unit/department council in addition to what is included in basic systems and regulations, includes arrangement at administrative or scientific activity of the unit or department under supervision of college council, school, institute or center.

Publishing house
28- The university will have a publishing house. The basic systems designate the method of its performance

Financial rules & audit
29- (1) The financial resources of the university include what the state allocates among fund, investments, self-resources and any other resources accepted by the senate.
(2) The university saves accounts correctly clears its financial operations according to law, basic systems and regulations
(3) The university deposits funds in current accounts or deposit accounts in banks appointed by the senate
(4) Expenditure of university funds will be to achieve its purposes according to rules of financial regulations.
(5) The general auditor audit the budget financial statement annually and the chancellor introduces a report of this issue to the senate

Final rules
Labors recruitment
30- Basic systems which are issued by the senate designate the method of all labor recruitment and their service conditions with attention to conditions of teaching staff
members and their assessment designates by the national council.

Labor upgrading
31- (1) upgrading of labors and teaching staff members takes place according to systems and regulations.
(2) The senate issues a regulations of labor upgrading of non-teaching staff members.

Labors audit
32- (1) Labor among armed forces succumb to audit according to act and regulations of armed forces.
(2) Labor among civilians succumb to audit according to regulations of high education and scientific research labors.

General and transitional rules validation of contracts, agreement and commitment.34- (3) any contract, agreement or commitment concluded by karary academy of technology will be valid before putting on this act and considered as if it was concluded by Karary University according to this act rules.(2) All funds, possessions, right and commitments of the destinations mentioned in article (1) to the university devolve(3) labor who were under services of destinations mentioned in article (1) continue the service in the same conditions of their previous service conditions unless the conditions reformed according to this act the best.
